The Terms and Conditions expressed in this document, along with all other included policies, are designed to provide a clear and written explanation of how Flies Canada conducts business and collects/uses information. It creates an agreement between business and consumer that is in place to ensure that both parties are fully aware of the terms of business. It is every company’s responsibility to provide their customers/users with information on how they do business, and Flies Canada aims to be at the forefront of operating with transparency. With this being said, please become familiar with all of the terms and policies mentioned in this document, and contact us if you need further assistance.

The Terms and Conditions stated in this document herein establish and create an agreement between the user and Flies Canada. In this document and throughout this website (www.fliescanada.ca), the words “our”, “their”, “us”, and “we” may refer to the company entity of Flies Canada and/or any employees or persons involved with the operation of the business. The words “buyer”, “seller”, “you” and “your” may refer to any user of this website.

By continuing to use our website you agree to our Terms and Conditions, and all of its included policies. You must agree to all of our conditions, if you do not agree you must not use our website or any service we offer.

Pricing/Payments:

All prices listed on our website are displayed in Canadian Dollars.

Flies Canada does not govern the price of any listing submitted, therefore, any price listed is subject to change at the discretion of the listing author at any time without notice.

Flies Canada does not handle any part of financial transactions between users on their website, and will not be held liable for any transaction amount. It is at the sole responsibility of the buyer and seller to negotiate payment transactions.

Flies Canada requires users to only use trusted payment terms such as e-transfer, credit card, or PayPal. All content is user submitted and displayed as is, it is up to buyers to communicate with sellers and only send payment when they determine it is safe to do so. Do not send any form of payment to any user if you feel uncomfortable doing so. Flies Canada will not cover any lost dollar amount.

Prohibited Content:

The Flies Canada marketplace found on this website is for listing Canadian-tied artificial fishing flies only. No other products will be accepted; fishing related or otherwise. Flies tied in any location outside of Canada, and/or by any non-Canadian resident, are prohibited from this website.

Any form of illegal, unethical, hazardous, offensive, counterfeit, false, and/or deceitful content is prohibited from this website.

Any form of direct contact information (phone numbers and email addresses) are prohibited from being posted within listings. To request contact information use the built-in messaging system on our website, or message the seller directly through their social media links. We cannot control who views our website at any given time and try to protect our users from spam. 

Any links to external sources, except for what is stated in our User Registration terms below, are strictly prohibited from being included in any profile bio or listing description on our website.

Flies Canada will not approve any listing that is not clear on what is available for sale, duplicate, unfinished, and/or deemed as un-authorized marketing.

Flies Canada reserves the entire right to refuse or delete any listing that does not abide by the entire Terms and Conditions at any time, without notice.

User Registration:

To use certain features of Fliescanada.ca you may be asked to register. Registration is open to anyone world-wide, however, only Canadian residents may submit listings. If you choose to register you agree to provide true, accurate, current, and complete information about yourself as prompted by any registration form; and to maintain and promptly update the information you provide to keep it true, accurate, current and complete. You may register under a pseudonym/business name only if the account/business is solely operated by you, in Canada, strictly around fly-tying. Fly-tying groups are encouraged to have their members create individual accounts, and to mention association within their profile descriptions. If there is reasonable ground to suspect that such information is untrue, inaccurate, not current, or incomplete, Flies Canada has the right to suspend or terminate your access to the website without notice.

You are responsible for maintaining the confidentiality of your password and account, and are responsible for all activities that occur under your password or account. You agree to notify us immediately of any unauthorized use of your password or account or any other breach of security, and to ensure that you exit from your account at the end of each session. Flies Canada cannot, and will not, be liable for any loss or damage arising from your failure to protect your password or account information.

All external links contained in your profile (Instagram, Youtube, and/or personal websites) must link to accounts owned by you, or link to a community that you are directly associated with (local fly-tying groups, shop pro teams, etc.). These links are included to help build integrity around your selling account, and help market your work only. Any link to an account not owned by you, deemed as un-authorized marketing, irrelevant, and/or spam is strictly prohibited.

As a user of our website you agree to not post any content that does not abide by all of our Terms and Conditions.

Messaging:

Flies Canada offers a built in messaging system for user privacy and convenience. Users must agree to only use this system in a responsible, respectful manner.

Flies Canada cannot view any conversation between users contained within this system, and therefore, cannot directly enforce against ill use. It is the sole responsibility of the members involved to ensure a safe environment. We offer and encourage the use of the reporting feature to keep our community safe. If any member communicates in any form of hateful, discriminatory, fraudulent, and/or unsafe manner and you have already reported them, please contact us regarding the issue immediately. 

It is at the sole discretion of the buyer and/or seller to communicate contact, personal, or payment information to another member. Do not send any information to a user if you feel unsafe doing so. Flies Canada will not be liable for any loss or damage to a member that results from information shared between users.

Selling:

Our marketplace service is designed for local, private sellers only. All listings must be placed from a valid email address that corresponds to a local Canadian IP address. We do not accept retailers, merchandisers, dealers, or brokers on our marketplace. 

Any promotional and/or business advertising must be approved by Flies Canada prior to being listed. 

All listing submissions will be reviewed by a Flies Canada moderator as soon as possible, and will be accepted or rejected according to compliance with all Terms and Conditions. Flies Canada reserves the entire right to accept or reject all listings at their discretion. 

As a seller on Flies Canada you hereby agree to list only genuine products and to represent them exactly as they are in reality. It is your responsibility to ensure product quality and value for any item you list. You must handle all customer service requests directly with your customers, in the most time efficient manner possible. Flies Canada will not process any support requests on your behalf.

Shipping terms must be negotiated and agreed upon between seller and buyer for any transaction. It is the seller’s responsibility to package all products in the safest manner possible and ensure suitable shipping means are used.

Buying:

Anyone around the world may use our service and/or contact buyers listed on Flies Canada, however, any sale is at the sole discretion of the seller to accept.

As a buyer, it is your responsibility to communicate the details in which you require. You must agree to be respectful, clear, and honest in all your communications. If you place an order you must provide accurate information and successfully pay the seller. False information and/or requesting an order without intention of actually paying, without discussing with the seller in advance, will have you banned. There is strictly zero-tolerance for false orders/requests.

As a user of our marketplace, it is your responsibility to report listings that do not comply with all of our Terms and Conditions.

Reviews:

We encourage all users to review sellers after they conduct business with them. This helps our community remain safe and helps other buyers make confident decisions.

Reviews must be authentic and free from any false and/or discriminatory content. All reviews submitted will be reviewed by Flies Canada to ensure safe compliance.

Flies Canada reserves the entire right to deny, filter, or remove any review that does not abide by the Terms and Conditions.

Reporting:

Flies Canada offers the ability to report listings, and highly encourages the use of this function when necessary. We cannot govern every aspect of user submitted listings and rely on our members to help keep the community safe. If you feel that a listing or user goes against any of our policies, please report the listing at your discretion. 

All reporting is done anonymously and informs our team of non-compliance issues. Our team will review the reported listings to determine if action needs to be taken. When infractions are minor, we will contact the offender to discuss corrective action.

Apart from our reporting feature, we encourage you to contact us with any other concerns you may have.

Flies Canada reserves the right to delete, suspend, and/or ban any listing or users on our website at any given time, without notice.

 Service Availability:

Flies Canada is committed to keeping their website functioning properly at all times and frequently performs necessary service maintenance. However, we cannot guarantee that the use of our website will be 100% error-free or uninterrupted at any given time. We reserve the right to make our website inaccessible, for maintenance or otherwise, for an undefined period of time without notice at our discretion. We will always try our best to resume functionality as soon as possible. When possible, we will give advance notice of scheduled shutdowns.

Limitation of Liability:

While Flies Canada attempts to remove all prohibited and generally objectionable material, it may become impossible to review every user submission. Therefore, you acknowledge that every user submission expresses the views of the author and not Flies Canada. Flies Canada will not be held liable for any content submitted to the website. Users are encouraged to use the report feature available on every listing to help keep the community safe.

Flies Canada will not be responsible for any part of processing sales between users, and cannot offer any product guarantee. All listings are user submitted and the corresponding author shall be responsible. Any transaction, shipping, customer service, and/or returns are the responsibility of the seller.

Flies Canada will not be held liable for any form of illegal and/or unethical trade brought upon by any of their services. It is the sole responsibility of the seller to ensure the products they are listing abide by all Canadian laws and restrictions.

Flies Canada and all of it’s employees and/or partners will not be held liable for any loss, property damage, injury, or death as result of accident or improper use of any product or service available on Fliescanada.ca. 

Flies Canada will not be held liable for any penalty pressed against a customer for illegal/unethical use of any products. Please review and abide by all local regulations in your area.

Privacy:

Flies Canada takes privacy very seriously, for all information regarding how we handle data please review our Privacy Policy (www.fliescanada.ca/privacy-policy/). This policy is integral to our Terms and Conditions.

Ethics/Regulations:

Flies Canada only promotes ethical and legal fishing practises. With this being said, we entrust all of our users to fish in a safe and proper manner with any product listed on our website. You must agree to never use a product in any form of illegal, unethical, or dangerous fashion. 

Always become familiar with local regulations surrounding the areas in which you plan to fish. Rules are in place for significant reasons and should always be followed and kept in mind. Please be a responsible angler.

If you sell your flies to a customer outside of Canada, please become familiar with all laws regarding cross-border trade of animal products before shipping. Some countries restrict the importation of such products. Flies Canada will not be held liable for any loss or damages in result of shipping prohibited items.

Amendments: 

We reserve the entire right to make changes to these Terms and Conditions at our own discretion. Your continued use of our website is bound by the terms in effect at the time of your usage. You agree to accept the current terms each time you access our website. We highly encourage all of our users to review these documents regularly for this reason.
